Tinjauan Yuridis Rekomendasi Pembatalan Pasangan Calon Kepala Daerah terhadap Eksistensi Panwaslu (Studi Kasus Penanganan Pelanggaran Pemilukada tahun 2018 di Kota Palopo)

This research was motivated by KPU in the Regional Head Election Law related to Panwaslu recommendation contained in Article 13 letter p where it was stated that one of the duties and obligations of the Regency/City KPU to immediately follow up on the recommendations of the Regency/Municipal Panwaslu on the findings and reports of alleged election violations. (The name for the election supervisory agency was still the Regency/City Panwaslu as stated in the Pilkada law). This study aims to understand the process of implementing of recommendation for Panwaslu in Palopo City regarding the cancellation of candidate pairs in the 2018 Palopo Mayoral Election and to analyze and find out the implications for election organizers and the legal status of Palopo City Panwaslu recommendations that were not followed up by the Palopo City KPU. Based on the type of data used in this study, the author uses a qualitative research type. Data collection techniques used are documentation, observation and interviews. Data analysis techniques used are data reduction, data presentation, and verification. Sources of data used are primary data and secondary data. The results shows that one of the tasks of the Regency/City Panwas according to article 30 of Law Number 10 of 2016 letters (b) and (c) was to receive reports and complete findings and reports. Recommendations and decisions issued by Bawaslu/Panwaslu are based on findings and reports on the handling of election violations that have gone through a process of clarification and review stages. The implications for the Palopo KPU commissioners who are not follow up on the Palopo City Panwaslu recommendations are permanent dismissals by the Election Organizing Cohort Board (DKPP), and the implications for letters of recommendation that are not followed up by the Palopo KPU resulting in no legal sanctions against the implementation of violations of Article 71 Paragraph 2 of the Law No. 10 of 2016References
