Pertimbangan Hakim dalam Memutuskan Perceraian Karena Perselingkuhan pada Masa Pandemi Covid-19 di Pengadilan Agama Kota Palopo (Study Kasus Nomor: 14.PDT.G/2021/PLP)

This study aims to determine the description of the case and the judge's considerations in deciding divorce cases due to infidelity in Case Study Number: 14/Pdt.G/2021/PA.Plp, narrative of the legal basis of judges' considerations in deciding divorce cases due to infidelity regarding Case Study Number:14 /Pdt.G/2021/Pa.Plp, and views of Islamic law regarding judges' considerations in deciding divorce cases due to infidelity in Case Study Number:14/Pdt.G/2021/PA.Plp.Based on the type of data used in this study, the authors using this type of qualitative research. Data collection techniques used are documentation, observation and interviews. Data analysis techniques used are data reduction, data presentation, and verification. Sources of data used are primary data and secondary data. The results showed that the judge's consideration in deciding the divorce case was due to infidelity during the Covid-19 pandemic at the Palopo City Religious Court (Case Study Number: 14/Pdt.G/2021/PA.Plp). The decision of the case for the judge has stages and rules. The presiding judge always puts mediation first, then if mediation is not successful then the final decision will be the last step. However, before that, the judges looked at the case with the reasons brought by the defendant or the plaintiff, if the reasons are strong, the judge will make a decision according to the results of negotiations with the panel of judges. The legal basis used by judges in deciding divorce cases due to infidelity during the Covid-19 pandemic at the Palopo City Religious Court (Case Study Number: 14/Pdt.G/2021/PA.Plp). The legal basis used by judges in deciding cases is based on Article 19 letter (f) of Government Regulation no. 9 of 1975 in conjunction with Article 116 letter (f) Compilation of Islamic Law which is supported by analysis of problems and the basis of Islamic law.
