Abstract

Waqf concerns not only fulfilling legal requirements but also applying normative principles derived from hadith to inform and underpin institutional procedures. However, the relationship between hadith interpretations on waqf and the procedural explanations provided by representatives of the Indonesian Waqf Board (Badan Wakaf Indonesia—BWI) in North Sumatra Province remains unclear—specifically, how hadith-based norms align with formal regulations and administrative practices. This study aims to analyze the normative principles of hadith regarding waqf, identify how these principles are understood and applied in the BWI’s procedural explanations and practices in North Sumatra, and examine the alignment and boundaries among these three aspects. The study employs a qualitative approach using a case study design. Data were gathered through interviews with institutional informants, alongside an examination of hadith texts, tafsīr literature, regulations, and relevant legal documents. The data were analyzed comparatively by linking hadith-based normative principles, formal legal provisions, and empirical observations. The findings indicate that the preservation of the principal asset, the fiduciary duty of management, and the sustainability of benefits are the core principles found in hadith concerning waqf. These principles demonstrate a substantive alignment with regulations governing waqf declarations (ikrār), registration, certification, asset protection, and the responsibilities of the nazir. In their procedural explanations, the informants’ understanding is reflected in their emphasis on document verification, drafting the Waqf Declaration Deed, land registration, and developing productive waqf assets. Gaps were identified regarding older waqf assets that lack formal documentation, as well as challenges related to coordination and the capacity of those managing the waqf. This study illustrates how hadith principles intersect with procedural explanations and waqf regulations at an institutional level, while also underscoring that normative alignment alone is insufficient to conclude that implementation is fully effective.
